In the first half of 2025, KazCIC protected the interests of Kazakhstani entrepreneurs amounting to over 58 billion tenge

In the first half of 2025, the Kazakhstan Chamber of International Commerce (KazCIC) ensured the protection of entrepreneurs’ interests amounting to over 58 billion tenge by confirming the presence of force majeure circumstances under a number of foreign trade contracts.

KazCIC is the authorized body for issuing certificates confirming the occurrence of force majeure. Such a document allows Kazakhstani companies to officially confirm their inability to fulfill contractual obligations due to circumstances beyond the control of the parties.

In April this year, a supplier involved in the sale of one-bedroom apartments in Almaty Region contacted KazCIC. Due to the absence of connection to the city’s power grid for reasons beyond the supplier’s control, it was impossible to fulfill the contract terms on time. As a result, the entrepreneur received a certificate from KazCIC confirming the occurrence of force majeure. The document was recognized as justified by the authorized state body, which exempted the supplier from a penalty payment of 40 billion tenge.

Also in 2025, a company was unable to fulfill its contractual obligations to deliver a boat under a state contract due to force majeure — flooding in Italy temporarily halted the operations of a plant supplying key components. The delay in equipment delivery affected the production timeline. The circumstances were confirmed by the authorized bodies of a foreign state and recognized by KazCIC as force majeure.

Another company faced force majeure circumstances caused by official bans and restrictions on transportation imposed by JSC “KTZ – Freight Transportation” in January 2025. As a result, the shipment schedule for wagons loaded with barley was disrupted, despite the timely provision of the train and loading in accordance with the schedule. The wagons remained idle for 37 days, leading to a claim from the partner in the amount of 24.6 million tenge. However, the delay was not the fault of the contractor, but was due to official KTZ orders restricting transportation toward China via Altynkol. The company submitted the case to KazCIC, which, after reviewing the documentation and circumstances, confirmed the presence of force majeure and exempted the applicant from liability for the delay.

Furthermore, in connection with the introduced ban on the export from the Republic of Kazakhstan of copper, aluminum, lead and ferrous metal scrap, used pipes, rails, and other metal products, the Kazakhstan Chamber of International Commerce reminds participants of foreign economic activities: if the execution of contracts concluded before the ban has become impossible or significantly hindered, companies have the right to apply to KazCIC for a certificate officially confirming the existence of force majeure circumstances.

Such a certificate may serve as a legal basis for revising contract terms and protecting the interests of Kazakhstani businesses both in court and in negotiations with foreign partners.
