What is force majeure and hardship?
- Force Majeure: Extraordinary and unavoidable events that make fulfilling contractual obligations impossible. Examples include:
- Natural disasters (hurricanes, earthquakes, floods).
- Military actions or acts of terrorism.
- Government restrictions or bans.
- Hardship: Significant changes in circumstances beyond the parties’ control that make contract execution extremely difficult or economically burdensome (e.g., sharp currency fluctuations).
When to request certification?
- If circumstances prevent you from fulfilling contractual obligations.
- To prove the presence of force majeure to partners, courts, or other organizations.
- To protect your interests in negotiations or legal disputes.
Rates:
- Legal analysis for obligations up to 100,000 KZT: 15 Minimum calculated indexes MCI (includes certification costs).
- For obligations exceeding 100,000 KZT: 15 MCI + 1% of the overdue amount, but no more than 4,500 MCI.
