On the procedure for obtaining a certificate of force majeure in connection with the ban on the export of scrap metals

In accordance with the order of the Minister of Industry and Construction of the Republic of Kazakhstan from 15 April 2025 № 127, from 29 April 2025 for a period of six months, a ban on the export from the territory of the Republic of Kazakhstan by all modes of transport waste and scrap of ferrous and non-ferrous metals, as well as a number of products for railway purposes.

Restrictions apply to the goods specified in the codes of HS of the EAEU, including scrap copper, aluminium, lead, ferrous metals and used pipes, rails, elements of rolling stock and other products.

In this regard, the Foreign Trade Chamber of Kazakhstan informs participants of foreign trade activities: in case the fulfilment of contractual obligations concluded before the ban was imposed was impossible or difficult, enterprises may apply to the Foreign Trade Chamber of Kazakhstan for a certificate of force majeure (force majeure).

This document serves as an official confirmation of force majeure and can be used to protect the interests of Kazakhstani companies within the framework of contractual relations.
