A property developer avoided losing 40 billion thanks to Kazakhstan's Foreign Trade Chamber

The Foreign Trade Chamber of Kazakhstan continues to provide systematic support to Kazakhstani businesses in difficult situations. One of the most recent cases was a clear example of how the force majeure mechanism can protect a supplier from unlawful sanctions.

In April 2025, the Foreign Trade Chamber was approached by a supplier of one-room flats in Almaty region. Due to the lack of connection of the object to the city power supply system for reasons beyond the supplier's control, it was impossible to fulfil obligations under the contract in due time.

Having applied to the MIC, the entrepreneur received an official conclusion on the presence of force majeure circumstances. The document was recognised by the authorised state body as justified, and on its basis the supplier's liability terms were revised. This made it possible to avoid financial losses for a penalty of 40 billion tenge and to confirm the legitimacy of the entrepreneur's position.

‘The Foreign Trade Chamber not only records the facts of force majeure, but also accompanies business in the legal field. We are glad that we managed to achieve a fair decision,’ said Murat Karimsakov, Chairman of the Board of the Chamber of international commerce of Kazakhstan.

The case of the developer from Almaty region confirms the importance of timely application for support and correct documentation of circumstances. The Foreign Trade Chamber of Kazakhstan will continue to protect the interests of Kazakhstani business, contributing to the strengthening of legal culture and business sustainability.
